Planning for a Successful US Visa

Getting a work permit (O or P visa) for the US as a foreign artist (or nonresident alien) requires a lot of advance planning and thoughtful consideration of the time required for the many steps involved, including the possibility of unavoidable delays.

It’s an unfortunate circumstance that artists are often unable to enter the US to perform because they simply run out of time for the visa process. Here are some suggestions:

First, an artist should start the process as soon as possible. Even beginning a year in advance of a proposed performance date or start date in the US is not too soon. Even if contracts have not yet been signed, you can apply for a nonimmigrant work permit (O or P visa) with deal memos, emails, or letters of intent, as long as they confirm that there are performance date(s). Of course, a foreign artist cannot apply for a non-immigrant work permit but needs to appoint a petitioner (a US-based individual or entity). Gathering this evidence and appointing a petitioner takes time.

Next, the required petition materials must be gathered and prepared to form part of the petition. These materials include passport photo pages from everyone who will be performing (passports need to be valid for six months beyond the proposed US dates), personal information, reviews, programs, biographies, letters of recommendation, lists of awards, a tour itinerary, etc. Although for the P-2 permit specifically, which for musical artists can only be obtained through the AFM, evidence of reviews, biographies, and other accomplishments are not required. It may take some time to gather this information, so start early.

Once completed, a formal petition is submitted to the USCIS office in either Vermont or California for regular or premium processing. Regular processing is less expensive than premium, but currently can take up to four months for an approval; in the case of a P-2 visa, these petitions have been taking 100 calendar days from the date of submission to the AFM. Premium Processing costs more, but USCIS guarantees a response in 15 days. However, even with premium processing, you must apply for the petition at least 25 days before entry to the US to ensure your Approval Notice will arrive in time. There is no guarantee of approval with either processing. At times, USCIS will require further evidence and this can cause unexpected delay in the process. All submitted petitions are issued a receipt number from USCIS, identifying the application.

Eventually, an approved petition will result in receipt of an I-797 form. USCIS will also send a copy of the petition to the Kentucky Consular Center for download to the Petitioner Information Management Service (PIMS). This can take a few days.

Canadian citizens, including Canadian members of the AFM, who are able to apply for P-2 visas, do not need to go to a consular interview, but can go directly to the Canada-US border with an approved I-797.

For non-Canadian citizens, once you have an approved I-797 in hand, you can schedule an appointment at your closest US Consulate. (Wait times for an interview vary from two to 40 days or more.) Go online to complete the required DS-160 Visa Application form, pay the required visa fee, and then arrive at the consulate for an interview with your DS-160 barcode page, proof of payment, and required photos. Once you have been approved for the visa, the consulate, will retain your passport, process the visa document (times vary from consulate to consulate), and make arrangements for these documents to get back to you.

Only after completing these steps are you able to go to the US with documents in hand and speak with a border official, at whose sole discretion you will be allowed into the country.

Take the time to determine the best timetable for getting through the process and ensuring that you will be able to be in the US for your performances.

Stretches That Every Musician Should Do Before PlayingEditor’s Note: In this article Janet Horvath suggests some stretches she devised to help musicians alleviate body stress. When I was a young student I was criticized for moving too much when I played. “Don’t beat your foot! Don’t wiggle! It’s too distracting,” said my teachers. Unfortunately, these mantras were more important than just limiting comfort and self-expression. Although playing music is expressive and creative, we sought to quell the tendency to move and flow with the music. We were admonished to never “stick out.” As a result, we often sit like statues.

Studies today indicate that humans are born to move. Being static, still, and motionless is detrimental to our health. Static effort, or holding a position, is also much more strenuous on the body. Muscles tighten, blood flow is constricted, oxygen is not replenished, and waste products are not flushed out. Static positions make us tire sooner, and then we hurt. On the other hand, we can engage in a dynamic movement for a long time because blood is replenished with fresh oxygen.

There are unobtrusive ways to reduce tension build up and give our bodies mini breaks. I have devised a series of moves I call Onstage Tricks™ to alleviate tension even while performing. The essential guiding factor is to do the opposite motion of the positions we are required to hold while we play.

Sitting properly is the first step. Make sure that you are sitting in the optimum position for your height and instrument. Your chair should be high enough so that your knees are lower than your hips. If you are diminutive, sit forward so your feet don’t dangle. Your weight should be forward with a slight lumbar curve in your spine and feet flat on the ground. Keep your shoulders down and facing forward. Avoid turning or twisting your torso, leaning left or right.

Starting with those targeting the top of the body, try some of the following moves during practice or performance, or whenever you have a few bars of rest. These exercises are effective even if you only have time to do them once. However, if you are able to do them more than once, it’s all the better.

The following are stretches that every musician should do before playing

For the neck:

  • Keep your head erect and tuck in your chin gently. This is a very small movement.
  • Tuck your chin as above. Keeping your shoulders relaxed and down, slowly turn your head to the right and look over your right shoulder; return to looking forward. Repeat, turning your head left, looking over your left shoulder.
  • Again, start with a chin tuck. With shoulders relaxed and down, slowly tilt your head so the right ear is over the right shoulder. Return to neutral. Repeat on the left side.

For shoulders and pectorals:

  • Do one big shoulder shrug bringing the shoulders toward the ears, while taking a deep breath. Relax, release your shoulders, and breathe out.
  • Do one big shoulder circle. Bring your shoulders forward, then up toward your ears, then back opening your chest, and relax bringing your shoulders to normal. Repeat, reversing the direction of the circle.
  • While keeping your shoulders down, squeeze your shoulder blades together.
  • Clasp your hands behind your back, and while keeping your elbows straight, but not locked, pull your shoulders gently backwards.

For the arms:

  • Let your arms uncurl often and hang by your sides. (If you must hold your instrument, do one arm at a time.) While keeping your elbows fairly straight, but not locked, turn your palms outward, with your thumbs pointing away from your body. Moving slowly, reach gently backward.
  • Place your hand palm down on the chair behind you. While keeping your elbow fairly straight, but not locked, lean gently onto your hand, stretching the inner arm. Repeat with the other arm.

For the back, spine, and pelvis:

  • Take a deep breath in and then empty your lungs. Now, contract your abdomen. Imagine pulling your belly button inward. Release.
  • Roll your pelvis forward and back, putting your back into a “C” curve. Momentarily press your lumbar spine backward and then return to neutral. This is a very small movement. Rock from one gluteus to the other, side to side.
  • Squeeze your buttocks and release. This can be done while standing or seated.

For the hips:

  • Keep your feet on the floor and turn one knee inward as you sit, rotating the hip joint. Repeat with the other leg.
  • Adjust the position of your feet often.

For healthy overall circulation:

  • Keep your heels on the floor and lift your toes. Then, keep your toes on the floor and lift your heels. Do circles with your ankles.
  • If you are able to, alternate playing seated and standing. While standing, avoid locking your knees; keep them slightly bent with feet apart. Avoid overarching your back and crouching or slumping forward. Keep your head and torso erect and face forward with shoulders down.

Awareness is the key to injury prevention. These and many more “moves” for musicians are displayed in my book. Make up some of your own as well, with the goal of maintaining fluidity and ease, while avoiding tightness and tension. You’ll feel better and you’ll play better too.

How to Lead the Audience

The first 10 seconds are the most crucial to winning over an audience. How you walk onto the stage is important. It gives the audience an idea of who and what is important. If you walk onto the stage initially looking at the other band members and their equipment, it appears that 1) you think you are more important than the audience or 2) you are ignoring the audience. If you walk onto the stage immediately looking out into the audience to see everyone, you convey the impression that you can’t wait to become friends with everyone. This immediately gives the audience a feeling of importance, and ultimately causes them to like you from the very beginning.

The best way to prepare for walking onto the stage is to have all of your equipment, microphones, guitars, drumsticks, etc. ready so that you can pick them up and/or put them on without even thinking about it. This enables you to be free to check out the audience from the first step you take on stage, and this starts the show off in the most personal and effective way possible. You’re confident, ready to give as a performer, and this is your time. Look them straight in the eyes, and then rock them!

Nothing Succeeds Like Success

Walk on stage as if you own it and you belong there. Exude confidence and success. Don’t confuse the terms confidence and success with cockiness. Cocky people are generally not well liked. On the other hand, people don’t want to follow someone who appears to be unsure of themselves or worse, a loser. They will follow a winner anywhere. A great smile will do wonders. It imparts the feeling that, “I know what I’m doing. I’ve done it a million times before. Come along with me. This is going to be great!”

Be You

One of the difficulties in explaining the best way to meet the audience is that performance styles can be so wildly different. For example, the high energy rock group KISS comes out blasting and uses a lot of intricate lighting and pyrotechnics. On the other end of the spectrum, jazz singer Norah Jones comes out performing a more low-key, sensitive marriage of music and lyrics. These two approaches are completely different, but they are completely correct for each act. The higher-power rock group needs to establish themselves as such. The warm and smooth singer-songwriter needs to likewise establish the environment and level of intimacy that facilitates the best possible presentation of his or her material.

The important thing to consider is how you and your group intend to meet the audience. Do your best to make a statement regarding who you are. Establish your character very early, and you will be able to take the audience on a journey from there.

Many years ago a famous R&B singer-songwriter, who had a number one hit song on the Billboard charts, was performing a live concert. After the house lights were dimmed and the singer took the stage, the audience went wild. They were anxious to hear some of the most brilliantly executed R&B music of the day. Instead of playing R&B, this artist started playing old standard songs, as if he were the piano player in a nightclub lounge. The crowd was forgiving, however, they were a bit disappointed. The expectation that a certain character would emerge from the stage at the outset didn’t happen. Once again, establish your true character early so you can move to take the crowd on a journey. Don’t start off on a tangent. You can journey toward this, but a tangent should never start or end a show.

After you have played your opening musical segment, the audience will applaud. Respond to the audience’s applause by thanking them and by making a statement that will help to establish the tone of the show for the night.

You Control the Show

Control of the show is a simple concept that can either make you or break you. Part of any successful relationship is knowing who’s in charge. You are in charge. There are no exceptions to this hard and fast rule. You should be in control of a number of things, including the overall feel of the show, the content, the amount and quality of interaction with the audience, and even the pacing of the show. You should always go in with these things in mind. Even though it is the audience who is buying the tickets, you should realize that they are paying you to be in charge.

Actors are always taught to never break character and to never allow hecklers or interruptive elements of any type to break their concentration and performance. As musical performers, somehow that’s never taught to us! But the concept works for any type of performer. Is there someone in the audience who is yelling out a request for a song continually? Is it distracting people from what you’re doing on stage? Is it distracting you from what you are doing? Move the show along. Don’t lose sight of what you’re on stage to do.

Apply and maintain pressure on the audience. Audience pressure is created when the performer’s actions on stage compel the audience to become interested and involved. The opposite of pressure, “dead air,” where the audience loses interest with what’s happening on stage, should be avoided at all cost.
